Some Victims Left Out

GM created the fund last year to compensate victims who were killed or injured by the defect, which caused the ignition switch to shift into the off position, simultaneously turning off safety features like power steering and airbags. Through a criminal investigation it was discovered that the company hid the problem from the public for more than a decade.

Earlier this month, Kenneth Feinberg, who was chosen to head the compensation fund, said they had finished processing the 4,342 claims it received. Of that total, 80 percent were identified as ineligible and 453 were deficient. Twenty-four of the deficient claims allege that a death resulted from the faulty ignition switch, while the rest claim injuries. Those with deficient claims have until the end of the month to provide additional documentation like medical records and photos to support their claim.

Unfortunately, the fund only covers 2.59 million vehicles with one specific flaw. There are another 10 million vehicles that were recalled shortly after for a very similar ignition switch problem. However, because GM recalled the vehicles immediately and did not try to hide the problem, the company has exempted those vehicles from eligibility for compensation from the fund.

Despite encouragement from Congressional leaders, the company chose to continue to exclude the 10 million additional vehicles and countless victims. Our experienced team of personal injury attorneys Silver Spring MD have been following the GM ignition switch saga from the very beginning and are prepared to represent those who have been injured or killed as a result of the faulty ignition switch.
