Silver Spring Social Security Disability Insurance Lawyers
If you’ve experienced a disabling condition that prevents you from working, you deserve to benefit from the Social Security Disability Insurance (SSDI) tax that you’ve been paying while employed. SSDI exists to protect workers who need financial help because they have a physical or mental impairment that prevents them from holding gainful employment.
However, did you know that most applications are rejected by the Social Security Administration (SSA) the first time that they are filed?
A skilled Social Security Disability lawyer can help you determine whether you’re eligible for these benefits. At the law offices of Goldberg Finnegan, our legal team has years of experience advocating for the rights of SSDI applicants, and we are here to help you today.
Take the first step in applying for Social Security Disability Insurance or appealing a denial of benefits by filling out our FREE case evaluation form, or by calling Goldberg Finnegan at 301-589-2999.
There are no upfront fees and we are ready to help you today.
SSDI Eligibility Requirements
More than 10 million people were awarded Social Security disability benefits in 2012, the Social Security Administration (SSA) says. The average SSDI disabled worker is 53 years old and receives disability benefits around $1,134.86 per month.
Those who are fully insured under Social Security can receive SSDI benefits.
To be fully insured, the applicant must meet the following criteria:
- Have a condition that is recognized by the Social Security Administration as disabling;
- Have a disability that is expected to last at least one year or result in death;
- Accrual of at least one quarter of coverage for each year after the age of 21 from working in jobs covered by Social Security.
If your condition prevents you from working, you could still be eligible for SSDI benefits even if you do not meet every criterion. An experienced Social Security Disability Insurance attorney can make this determination.
What to Do if Your Benefits Are Denied
Benefit denials can be appealed within 60 days of the date of your denial. To begin the appeals process you should contact a lawyer immediately. There are numerous steps that must be completed to successfully appeal the decision, which include a request for reconsideration, a request for a hearing, a request for a hearing to review the decision by the Appeals Council and a Judicial Review in Federal Court.
While the process may be lengthy, a denial of SSDI benefits does not mean there is no hope. Appealing the SSA’s initial decision is an important part of ensuring you receive the benefits you deserve, and our attorneys are here to help you do just that.
