What Does the False Claims Act Cover?
When a corporation commits fraud against the government, the False Claims Act empowers employees to blow the whistle on the company. Many of these claims address Medicare and Medicaid fraud, charging for nonexistent products or services, overcharging the government, contractors charging double for one service, or failing to ensure that products meet health and safety standards.
What Damages are Available in Whistleblower Claims?
Corporations found guilty of fraud in a qui tam case may be liable to pay the government up to three times the amount of the damages created by the fraud; a whistleblower is entitled to 15-30% of those damages. The compensation that is provided includes double back-pay, compensation for damages or costs incurred, and reinstatement.
Recently, Congress has enhanced the Securities Exchange and Commissions Whistleblower program. This increases the amount payable to the whistleblower because of the information they provided to the SEC about a corporations violation of federal securities laws.
